www.metour.it is an online platform of MeTour LTD with registered office in Malta at Business Labs, Level 1 - Dun Karm Street Birkirkara Bypass BIRKIRKARA BKR 9037 MALTA and VAT number MT26692313. MeTour LTD is owned by MeTour Holding based in Malta. MeTour® is a registered trademark owned by MeTour Ltd.
metour.it does not make use of third-party agencies, partners, brokers or anyone else who resells products or operates in the name and on behalf of metour.it or manages the site itself.
For any question relating to metour.it, the online booking service (e.g. for catering establishments, guides, experiences, services, accommodation facilities, transfers), the Website, the contents and images of the site, the guides to places to see, to send or use documents, correspondence, affiliations, registration, notices, communications of any kind regarding MeTour.it, the Service and the Website, it is necessary to contact metour.it directly through the channels made available on the metour website .it in the “contact us” section.

2. Information for the User

Registration on the www.metour.it platform facilitates the offer of "individual or connected tourist services" that you have optioned on the site and also the purchase of different types of tourist services purchased for the purpose of the same trip from different entities. The purchase more services, unless expressly declared as a package, does NOT constitute a tourist package, this ALWAYS involves the conclusion of separate contracts with the individual service providers. Therefore, you will NOT benefit from the rights that apply to packages pursuant to directive (EU) 2015/2302 and our agency will not be responsible for the correct execution of the individual tourist services offered by you or by other partners. In case of problems the user who has purchased the service should contact the relevant service provider.
MeTour® LTD asks its members to be faithful and truthful in recording their data, but assumes no responsibility for confirming the identity of any Member Partner and/or his conduct. Notwithstanding the foregoing, for transparency or fraud prevention purposes, and as permitted by applicable laws, it may, but is under no obligation, require Members to provide appropriate identification issued by relevant authorities or other information, or carry out additional checks intended to verify identities about Members against third-party databases or other sources and to request compliance reports from service providers and or information sufficient to identify an MT Member, obtain reports from public records in relation to criminal convictions or offender registrations sex offender or an equivalent version of background checks or sex offender convictions in your local jurisdiction (if available)
On the "www.metour.it", MeTour LTD website, potential customers (users) will have visibility of a wide range of tourist offers such as (for example and not exhaustive) accommodation facilities, catering services, guided tours, experiences , entertainment, ticket purchase, travel, rentals.

3. Acceptance of the General Contract Conditions

Only Users/Customers who have previously viewed and unconditionally accepted these general terms and conditions as part of the process of completing their booking will be able to use the Services offered by the suppliers/partners present on our booking platform "www.metour.it". In the event that a Client does not accept the general conditions, it will not be possible to complete the reservation. The Clients agree to fulfill the obligations contained in these General Conditions. The contract between the Client and the relevant Tourist Service Provider enters into force as soon as MeTour® Ltd provides written confirmation of a booking to the Client with the Booking Confirmation Email. When Clients make a booking they should save and/or print a copy of these terms and conditions for future reference.
These General Conditions of Sale, the Booking Confirmation Email and the related Rules and Restrictions represent the terms on the basis of which MeTour Ltd and the Suppliers/Partners of Tourist Travel Services, sold through the booking platform “www.metour. it", agree to provide the services to the Client/User.
The User accepts that every electronic document, whether it is a contract, notification, information, or other communication, satisfies the requirement of the written form when required by law; The User is made aware that the content of the site or made available by the site in the form of images, logos, texts and more is the property of the site itself or of its members and is protected and defended by legislation on copyright and copyright , so much so that it is not permitted to extract or reuse parts of the site or of the services rendered without the consent of Metour.it;

4. Provision and Responsibility for Tourist Services offered

The www.metour.it Platform is an online marketplace that allows third parties that offer tourist services (here called Suppliers / Partners) to publish these Services on the www.metour.it Platform ("Announcements") and to communicate, advertise and offer directly to Users who are visitors to the platform and to book these Services. Users can only book services with their registration on the www.metour.it platform. The Services of our Partners / Suppliers may include the offer of Hotel Services (Hotels, B & Bs, Hostels, Farmhouses, Private Houses, holiday homes or other accommodations), Reservation of Catering Services (Restaurants, Farmhouses, Taverns, eno gastronmiche - private dinners, etc), activities of one or more days in various categories ("Experiences"), access to special events and places ("Events"), Rentals and various other services related or not to travel. MeTour LTD does NOT directly provide the services offered on "www.metour.it" and consequently is NOT responsible for the facilities or services offered.
When you book through the "www.metour.it" website, you engage in a direct contractual relationship with the supplier / partner with whom you made the booking Metour.it communicates the data relating to your booking to the supplier concerned (or to the suppliers interested) and send a confirmation e-mail in the name and on behalf of the Supplier / Partner.Our booking service is free for the user.
MeTour LTD does not own, create, make available, control, manage, create or provide the Tourist Announcements or Services on the www.metour.it platform, nor is it an organizer or seller of tourist packages pursuant to Directive (EU) 2015/2302 .

5. Suppliers - Partners

5.1 The suppliers (partners) have registered on the metour.it site in the "partner" section and from there they have independently published their offer, taking care of and assuming responsibility for the prices and content published (including photos and / or videos) , guaranteeing the truthfulness, punctuality, updating of the information provided, to be the owner or, in any case, to have a gift contract for the use and sale of the goods offered, guaranteeing to have all the necessary authorizations, to make use of any personnel regularly hired, trained and insured, to be in compliance with all safety regulations, insurance, to possess or be authorized to use places and any ancillary equipment, to make all equipment available to its customers / users / patrons safety and individual protection (where necessary and / or required by law) in a good state of maintenance and certified in order to have the licenses for the use of ma rchi or assets covered by copy right or intellectual property. The suppliers (partners) who are registered on the metour.it site in the "partner" section and who show their offers on the "www.metour.it" site are professionals who have signed a contract with MeTour LTD through the "www.metour .it ".
Professionals and non-professionals who do not sign the contract with MeTour LTD, through the air partner of "www.metour.it", will not be able to see their service or product published.
Verifying the identity of the Internet Provider / Partner is difficult and Me Tour LTD assumes no responsibility for the confirmation of the identity of any Member or its conduct. Notwithstanding the foregoing, for purposes of transparency or fraud prevention, and as permitted by applicable laws, it may, but is not under any obligation to:
A) require Members to provide appropriate identification issued by the competent authorities or other information, or carry out additional checks to verify the identities or personal background of Members;
B) carry out checks on Members on third party databases or other sources and request regularity reports from service providers or sufficient information to identify a Member, obtain reports from public records in relation to criminal convictions or records as an offender sexual or equivalent version of background checks or convictions for sex offenses in your local jurisdiction (if available).
5.2 Many of the Partners hosted on MeTour.it come from automatic marketplaces, from which MeTour.it draws structures with the related text, descriptions, addresses, any stars, features, photos, rooms, features, services, policies, availability, rates and to which always automatically turns any bookings made by customers. In this case MeTour is not responsible for the correspondence and truthfulness of the information, photos, features, availability and rates published, but ensures that it works with continuous verification both autonomously and in the event of reporting by customers or operators.

Even if MeTour LTD will make use of all its abilities and attentions in asking suppliers / partners for verification, truthfulness and punctuality of the offers published by them on our web platform www.metour.it, La Metour LTD cannot be in any way held responsible for what is published by the partners, it is obliged to verify it and therefore cannot guarantee that all information and all descriptions of the advertisements of the partners / suppliers are accurate, complete, correct or updated, nor can it be held responsible for errors (including obvious errors), interruptions (due to temporary and / or partial failures, repairs, updating or maintenance of the Site or other causes), inaccurate, misleading, untruthful or missing information. Each Partner / Supplier is responsible at all times for the accuracy, completeness and correctness of their information relating to their ads and displayed on our website "www.metour.it". The conditions or circumstances of the market may undergo rapid changes, making the Inaccurate or obsolete data displayed on the Site In case of problems, our Customer Support Service will provide you reasonably with the commercial support needed to help you and will be a point of contact with the Supplier / Partner.Note that MeTour LTD is one of the many channels that Facilities use to make their offer available to bookings by tourists.When a search result shows that a particular property has no more rooms available, this means that the rooms are not available for booking through other channels. metour.it does not constitute and should not be understood as a recommendation or approval of the qu quality, level of service or evaluation of any Structure or Tourist Service listed in it. MeTour LTD does not recognize any responsibility, guarantee or commitment in relation to the quality, state or adequacy of the tourist services present on the site.

7. Payments and Pre-Authorizations

9.1 Payments: After following the registration procedure and acceptance of the conditions of sale and privacy, users will be able to regularly purchase and pay for the services they have chosen and placed in the "cart".
Payment can be made by bank transfer (through your bank) or for electronic payments such as Credit Cards, PayPal, Google Pay, Apple Pay (and all other types of payments made available on the MeTour.it platform) through the procedure guided and secure on the PayPal or Sripe payment platforms (depending on the payment chosen) directly to MeTour LTD, owner of the "www.metour.it" platform. These platforms offer absolutely secure payments for encrypted and certified according to PCI DSS Approved by the main circuits credit card issuers and is managed by the Payment Card Industry Security Standards Council and who comply with all the fundamental standards for the protection of privacy according to the GDPR Standard.
9.2 Pre-authorizations: MeTour.it, in agreement and where requested by its partners or by the type of service or booking condition requested, reserves the right to check the validity of the credit card before the customer's arrival by requesting a pre-authorization from the membership. With the MeTour.it pre-authorization, the temporary availability of the total amount of the stay, or part of it, is guaranteed to ensure that the credit card is valid. NO AMOUNT IS COLLECTED. The pre-authorization expires automatically after 20 days from the requested date and the amount is released. In case of pre-authorization with a negative result, the customer will be notified and the reservation will be canceled. In this case MeTour.it will have no obligation towards the customer.
If the Partner who offers the room or service to be booked uses automatic software for searching availability and booking (see partner Marketplace), the Preauthorization request to the customer's credit card circuit could come directly from him, and not from MeTur.it, with subsequent possible withdrawal of the money in case of confirmation of the booking (according to the booking policy).
9.3 MeTour LTD, for greater customer protection, will provide the payment to the Partner / Suppliers, withholding its commission established in the regular contract signed with the Partner / Supplier, only after the use of the service purchased by the customer / user on "www .metour.it "(for example after having stayed at the supplier's facility or used one of its services or products).
9.4 To protect the customers / users of "www.metour.it", if a supplier / partner fails to fulfill its obligations towards the user himself or who has purchased a service or towards MeTour LTD, he could see, at our sole discretion, could be removed from our platform www.meour.it and with it all its advertisements / tourist offers.

8. Reservations

7.1 The booking of the service or tourist services offered on "www.metour.it" must be made following the entire procedure indicated on the site. The acceptance of the booking is considered completed, with consequent conclusion of the contract, when the Customer, upon payment by bank transfer or electronic payment system, has received confirmation of the reservation by email (to the address indicated by the customer / user at the time of purchase) from MeTour Ltd. The reservation can be confirmed by the supplier / partner (provider of the purchased service) only and exclusively starting from the actual receipt of payment by the customer / user towards MeTour Ltd. The payment could be credited in a few moments, minutes or hours (if a payment is used such as PayPal or Credit Card or Other service) or in a few days if made by bank transfer (according to the agreement between the banks). lack of final confirmation from MeTour LTD within 24 hours of purchase, the operation is to be considered void and in this case any amount paid will be duly credited back to the Customer's account. It is acknowledged that MeTour LTd, through its booking platform "www.metour.it", has, vis-à-vis the Organizer supplier, the legal capacity of Intermediary and not of seller or provider of the purchased tourist service. The contract between the purchasing parties o reservation is considered valid and concluded only and exclusively from the receipt of payment by MeTour Ltd as owner of the MeTour.it platform.
7.2 Automatic Management of Availability and Reservations : Once the payment has been made, the transmission of the reservation to the Partner can take place directly and automatically where the Partner adopts an automatic management of availability and reservation or with systems that require "manual" confirmation where, instead , the Partner is not equipped with these automatic systems. In the case of "manual" acceptance by the Partner of the reservation, the confirmation to the customer may arrive within 24-48 hours following the reservation.
7.3 Please note: Placing a reservation or purchase for a service or good in the cart or wish list, without paying for it promptly, does not generate any priority or prerogative right and therefore the same will in any case be available for sale on the MeTour site. it to those wishing, in the meantime, to book or buy them.

9. Booking confirmation

The Booking Confirmation Email, which will include the essential elements of the same such as the description of the Service (s) booked and the price, will be sent to the User / Customer who made the booking via email to the address from he indicated when booking on the site. If the Booking Customer does not receive an e-mail confirming the reservation within 24-48 hours of making a reservation, he must contact the Customer Service Department by sending an e-mail through the "contact us" section of our website "www.metour .it ". It is understood that the data stored in the computer systems of "www.metour.it" will constitute proof of the reservations made by the User / Customer. The data stored in computers or on electronic media therefore constitute valid proof, and must be accepted under the same conditions and with the same proof value as a document written in paper form.
Immediate or Deferred Booking Confirmation: Once the payment has been made, the confirmation can be immediate if there is a direct and automatic connection (automatic management of availability and reservations) between MeTour and the Structure (see Hotels, Restaurants, Museums, Services etc), but it could be deferred and arrive within 24-48 hours following the booking if the partner does not use automatic availability and booking systems and therefore, this operation must be confirmed "manually".

10. Local Taxes or Additional Charges

The rates, conditions and information, as well as any additional taxes or costs or equipment rental or "optional" supplements, shown in the proposals on the "www.metour.it" site are set and decided independently by the suppliers / partners or imported automatically through linked marketplaces.
10.1 Accommodation Facilities, Apartments and Accommodations: unless otherwise indicated, the rates are per accommodation and for the entire duration of the stay. Any local taxes and additional costs (unless expressly indicated as "included in the rate") will be payable directly on site and may vary according to the country, the structure, the type of accommodation selected and the number of guests. The description of each offer, where possible, indicates which taxes are included and which excluded and when and where applicable. The rates will bring the details of what is included and what is not, plus any "optional" services that can be booked directly on the site. Any shortcomings of this information, in any case, can never be attributed to MeTour.it because they are requested and published directly by the Partner who owns the offer booked (even if they come from automatic marketplaces). The description of the offer shows all the equipment and services offered by the structure, paying attention that one or more services may not be included in the rate. Additional costs, such as breakfast, may not be included or, where provided, to be paid, in some cases, directly to the property on site.
10.2 - Catering Facilities: MeTour LTD through its booking platform "www.metour.it" allows its customers / users to reserve a table at a restaurant, farmhouse, trattoria, self service, bar, entertainment venue, etc. o to book and pay in advance a dinner or lunch with pre-established menu and price as per the conditions published on the relevant page of the website "www.metour.it". In case of reservation only, the customer / user can book, following the guided procedure, a table in the structure chosen from those proposed on "www.metour.it" by establishing the day, time and number of people. For this reservation the user will pay a “reservation fee” to MeTour Ltd through the purchase procedure and as indicated on the proposal. This "booking fee" will then be fully discounted by the supplier / partner on the bill to be paid on the spot directly to the structure. In some cases, where specifically indicated, the reservation of a table made through "www.metour.it" may also give the right to an "entrè" or a free aperitif offered by the partner / supplier upon arrival at the facility. If, on the other hand, you book a lunch or dinner with a set menu and price, the prices must be intended per person and the cost will be paid in advance, using the guided procedure of the "www.metour.it" shopping cart. Anything not included in the menu will be paid on the spot directly to the structure.
10.3 - Tickets: prices are per person or group. The currency converter on our site is for the sole purpose of giving you information. The amount indicated cannot be considered accurate and final until the time of the actual booking, as exchange rates may vary. At the time of purchase, a "presale fee" or "skip-the-line service" may be added to the cost of the ticket. Any "additional" costs will be duly reported both in the "product" sheet and in the "cart" before purchase.
10.4 - Tours / Experiences / Guided Tours / Entertainment: prices are per person or group. Any taxes, equipment rental, insurance or local charges (unless specifically indicated as included) must be paid directly to the partner / supplier on site.
10.5 - Rentals (no cars): prices are per person or group. Any taxes, insurance or local charges (unless specifically indicated as included) must be paid directly to the partner / supplier on site.

11. Policy / Booking Conditions / Cancellation

The invitation to all customers who book on MeTour.it is to always carefully read the Booking and / or Cancellation Policies and Conditions shown on the cards of the services or tourist facilities offered on the platform, but also those reported in the summary " Read the Conditions "that you find when choosing the room or service and, always, in the cart.
In particular, always read with particular attention the conditions and cancellation policy because if you book a room, a ticket or a tourist service declared "NOT CANCELLABLE" in the booking form, this will mean that in case of cancellation or impossibility to use it, no refund. it may be requested or waited for.
All services, room, restaurant, service, tour, experience, tiket, service, etc. bookable or purchasable on MeTour.it must be understood as NON-CANCELLABLE and therefore NON-REFUNDABLE, unless expressly stated in the relative booking form, according to the relative policies or booking conditions of the service, room, tour, experience, ticket, etc. buy.
The Booking / Cancellation Policies and Conditions, where possible, are always dictated, published and managed by the Partner providing the service or structure that can be booked on MeTour.it and for this reason MeTour.it does not respond or can be held responsible for them. Any dispute or dispute must always be addressed to the Partner providing the booking and never to MeTour.it.
Any cancellation must always take place either through the customer area on MeTour.it (protected by login and when you have chosen to register on the site) or in writing via the contact form or at info@metour.it. - Telephone cancellations will not be accepted.
Remember that: Each reservation, after its confirmation, has the value of a contract according to current legislation. The contract, conditions and policies included, is binding for the person making the reservation and for all the other subjects mentioned therein, including minors.

12. NoShow (no-show) and Late Arrival

In case of no show (No Show), the total amount of the booked stay will be charged. Any delays with respect to arrival must be communicated directly to the Partner or to the Accommodation booked and in any case accepted by them. For arrivals with a delay greater than 24 hours, the reservation could be canceled for the entire stay with, however, the full amount due be charged.

13. Withdrawal or modification by the User / Customer

The User / Customer can withdraw from the contract, without paying penalties, in the following cases:
- price increase referred to in point "7" above in excess of 8%,
- significant modification of one or more elements of the contract (objectively configurable as fundamental), in order to use the tourist service purchased and proposed by the supplier / partner through "www.metour.it" after the conclusion of the payment and the confirmation receipt by e-mail, but before the departure of the user / customer.In the above cases, the consumer has alternatively the right:
- to take advantage of an alternative tourist service, at no extra cost or with the refund of the excess price, if the second has a value lower than the first;
- This refund will be made as soon as possible and, in any case, within 14 working days from the moment of receipt of the refund request.
The user / customer must communicate his decision (to accept the modification or to withdraw) no later than 2 working days from the moment in which he received the notice of increase or modification. In the absence of express communication within the aforementioned term, the proposal formulated by the organizer is considered accepted. The consumer who withdraws from the contract, before departure outside of the hypotheses listed, will be charged the amount of a penalty to the extent indicated below:
reimbursement of the total amount purchased (excluding penalty of € 50) up to 32 days before departure;
penalty of 30% of the total amount purchased from 31 to 21 days before departure;
penalty of 50% of the total amount purchased from 20 to 14 days before departure;
penalty of 75% of the total amount purchased from 13 to 7 days before departure;
penalty of 100% of the total amount of the practice after these terms.
No reimbursement will be granted to those who do not show up at the place, date and time set in the booking confirmation received by email or who renounce during the course of the booked service. Likewise, no reimbursement will be due to those who cannot make the trip due to lack or invalidity or insufficiency of the required personal identity and expatriation documents. MeTour LTD reserves the right, without obligation or responsibility, to:
- reimburse any amounts recovered relating to services not used following renunciations;
reimburse any amounts recovered relating to services not used during travel or for various services obtained, provided that the Traveler provides written documentation.
The Customer / User also has the right to partial and not total withdrawal, in the event of the purchase of multiple tourist offers on the website www.metour.it, even from multiple suppliers / partners.

14. Cancellation by the User / Customer Reservation of Catering Services

In case of cancellation by the user / client of a table or dinner menu and fixed price reservation, the following reimbursement policy applies:
no refund will be made for cancellations within 24 hours of dinner / lunch
for cancellation within 48 hours of dinner / lunch a 50% refund of the amount paid will be paid
for cancellation within 72 hours of dinner / lunch 100% reimbursement of the amount paid will be paid
These refunds may not apply to event dinners / lunches, Christmas or Easter holidays, when otherwise indicated in the supplier / partner sheet.
The cancellation and the consequent request for reimbursement must be communicated in writing through the "contact us" section of "www.metour.it" indicating the reservation number and the name to which you have booked + Iban to which correspond the amount paid with relative name of the current account holder (which must necessarily correspond to the name provided at the time of booking).
Nothing will be reimbursed in the event of cancellation by the Customer User of only the booking of a table and if he had paid a reservation "right".

15. Modification or cancellation by the Supplier / Partner

In the event that, within 24 hours of the start of the provision of the purchased tourist service, the Partner / Supplier communicates its impossibility to supply one or more of the services object of the purchase by the user / customer, proposing a alternative solution, the consumer can exercise the right to be reimbursed the sum already paid or to enjoy the proposed alternative tourist offer. The Supplier / Partner can also cancel the contract without compensation when the minimum number of travelers provided in the tourist service card offered on "www.metour.it" has not been reached, provided that this fact is brought to the attention of the User / Customer at least 15 days before the date on which the trip or stay was to begin.

16. User / Customer name change

The renouncing User / Customer, if foreseen, can be replaced by another person provided that:
a) www, metour.it is informed in writing within 7 working days from the expected date of the start of execution of the contract / of the use of the booked tourist service. The communication must take place through the "contact us" channel, receiving at the same time communications about the details of the renouncer and the incoming customer user;
b) there are no reasons such as to make it impossible for a person other than the renouncing Customer to use the package;
The name change could generate an additional cost compared to the amount paid at the time of booking.

17. Changes after the "Departure"

The customer who has made a reservation on MeTour.it declares to be informed that in the case of the Partner / Supplier, if after "the start" of the service purchased by the user / customer, he finds himself unable to provide for any reason, except for a fact of the consumer, an essential part of the services contemplated in the contract, will prepare alternative solutions, without price supplements to be borne by the contractor and if the services provided are of a lower value than expected, will provide for a refund to the extent equal to that difference.

All information on the structures shown on the site "www.metour.it" is based on information communicated and updated directly by the suppliers / partners, who update prices, availability, descriptions, services and options at their sole discretion, through the reserved air to which they have access.
In case of reservations added to the cart or to the wish list, before proceeding with the purchase, it is advisable to update them and reread them carefully if, in the meantime, changes have occurred.

The MeTour LTD, through its booking platform "www.metour.it", publishes individual services or products (for example catering facilities, guides, experiences, services, accommodation facilities), each with its own description and price, offered by one or more partners / suppliers, which the customer / user decides, always individually, to place in his "cart" and, therefore, to purchase through the procedures described in the previous points "5" of these "conditions of sale".
If, instead, the offer of the supplier / partner were to be a Tourist Package, this will be specifically indicated in the description on the website www.metour.it and in any case will be, in any case, described, provided and provided by the Supplier / Partner who will have all legal and insurance authorizations to do so, without MeTour LTD being responsible in any way.
CONCEPT OF TOURIST PACKAGE

26. Supplier / Partner responsibility

The Supplier / Partner is liable for damages caused to the User / Customer due to total or partial non-performance of the services purchased through the "www.metour.it" platform, unless the disputed deficiencies are attributable to the Customer, including initiatives autonomously hired by the latter during the provision of tourist services, or when the event proves extraneous to the provision of the services provided for in the contract, caused by force majeure or by circumstances that the Supplier / Partner could not, with all the necessary diligence, reasonably to foresee or resolve such as: strikes of any nature, changes in the operating / timetables of line transport companies, etc. The MeTour LTD owner of the platform "www.metour.it", through which, possibly, the booking and purchase was made, is not responsible in any case for the obligations arising from the non-fruition, but is solely responsible for the obligations arising from its acting as an intermediary or in any case within the limits for this responsibility set by the laws or conventions mentioned above.
The User / customer, by accepting these conditions also reported in the individual purchase forms, is aware and informed that:
A) the holder of the tourist service offer (Partner / Supplier) is exclusively responsible in case of non-fulfillment, or partial non-fulfillment, or modification of its offer; Failure to comply, partial non-fulfillment or modification of its offer by the Supplier / Partner member not being attributable to MeTour will be governed by the relevant regulations, the MeTour is extraneous to any dispute between the parties;
B) MeTour LTD, as provider of the Platform, does not possess, does not create, does not sell, does not sell, or makes available or controls, nor manages, offers, delivers or provides Ads or Services published that are offered and loaded exclusively by the registered Suppliers Partner, is not an organizer or seller of tourist packages pursuant to Directive (EU) 2015/2302 Law 2018;
C) there is no type of employment or subordination or partnership relationship between MeTour LTD and the Suppliers / Partners members who offer their offers and publish their tourism products on the platform;
14- the User, by signing these conditions also reported in the individual purchase forms, is aware and informed that the MeTour collects from the user (User) the price of the service offered and undertakes to pay it to the MT member, holder of the offer , minus the agreed percentage and the possible penalty as per point 17.
15 - The User is aware and consents that Metour through online payment instruments, collects the price of the service offered by the User with the obligation to remit the amount deducted the percentage agreed upon and / or the penalty to the holder of the offer.

27. Compensation limits

Compensation and related statute of limitations are governed by the provisions therein and in any case within the limits established by the CCV, by the International Conventions which govern the services which form the object of the tourist service, as well as by the articles, with the exception of personal injury not subject to set. MeTour Ltd and its www.MeTour.it platform are not the direct suppliers of the tourist services purchased, but simple mediators and as such cannot in any way be involved in claims for compensation. Claims for compensation must be collected from the direct service providers who, in the case, MeTour lTd will help identify and contact. In any case, MeTour is liable for any dispute or compensation for a maximum amount of 5,000.00 euros (or equivalent in another currency) including taxes and legal fees.

28. User / Customer Obligations

The Site helps the User / Customer to find tourist and travel services and to make the necessary reservations, and operates as an interface in the transactions made with Travel Service Providers. 29. Assistance obligation

Me Tour® LTD does not approve any Member, Announcement or Service published on the www.metour.it platform. Any reference to a Member being "verified" (or similar wording) only indicates that the Member has completed the relevant verification or identification process and nothing else. Such indication does not constitute an endorsement, certification or guarantee by MeTour® LTD with respect to any Member, including as to the identity or personal background of such Member or that the Member is reliable, safe or adequate. You must always exercise due diligence and care when deciding whether or not to stay in an Accommodation, participate in an Experience or Event, use other Services, accept a booking request from a Guest, or communicate and interact with other Members, both online and in person.
The Images published on the www.metour.it platform are intended only to provide a photographic representation of an Advertisement at the time the photograph was taken and therefore do not constitute an endorsement by MeTour® LTD

31. Complaints and Disputes

MeTour LTD does NOT directly deliver the services offered on "www.metour.it" and the contract is stipulated directly between the supplier and the user (see point "3" of these "terms of sale"). Therefore, any complaint or dispute regarding the conditions of use or provision and / or quality of the service purchased (be it a stay, a catering service, a guided tour, a transfer, etc.) they must be addressed directly to the supplier / partner and in copy, for information, to the MeTour LTD through the "contact us" section of our platform "www.metour.it". If a solution is not found to the question, MeTour LTD undertakes to mediate between the parties in search of an adequate solution and mutual satisfaction.
Except in cases where it is established differently by public order authorities, any dispute arising from the use of our services and general terms must be sent to the addresses of the MeTour LTD in the ways indicated "contact us" on our platform "www.metour.it" ".
In any case, if the complaint is not resolved on the spot or by the supplier / partner, the claims for claim or reimbursement must be submitted in writing via e-mail, through the contacted section of our website www.metour.it, by and no later than 7 days from the date of return or use (or failure) of the service purchased, providing the booking details and any relevant information. We invite you to send timely and timely emails.
The Customer can also access the online dispute resolution platform of the European Commission (ODR) at http://ec.europa.eu/consumers/odr/. This ODR platform is a means of registering the complaint with MeTour Ltd; will not determine how to resolve the complaint.
Please note that failure to report problems during the execution of the service purchased, as indicated above, prevents MeTour LTD and the Supplier / Third Party Partner from investigating and rectifying the complaint locally and that this may affect the Customer's rights with respect to this contract, even reducing any due compensation, potentially eliminating it.

32. JURISDICTION / ARBITRATION CLAUSE

For any dispute concerning the interpretation or execution of these clauses between the User / Customer and the Supplier / Partner executing the contract for the service purchased, the forum will be the one decided by the parties. With the exception of cases in which the Public Order Authorities are established otherwise and MeTour LTD is also called to answer, only the Court of Malta will be competent. By mutual agreement, however, it may be provided that disputes arising from the application, interpretation, execution of the contract, are devolved to the decision of an Arbitration Board composed of as many arbitrators as there are parties to the dispute and by the same appointed, plus one who acts as President, appointed by the arbitrators already appointed, or, failing that, by the President of the Court of Malta. The Arbitration Board will decide ritually and according to the law, subject to any attempt at conciliation.

33. Activities and Experiences

34. Certainly

If meals are included in an offer, the number of meals depends on the number of nights. Full board normally includes breakfast, lunch and dinner. Half board normally includes breakfast and lunch or dinner, depending on the type of offer. Accommodations that include main meals generally start with dinner on the day of arrival at the property and end with breakfast (in the case of half board) or lunch (in the case of full board) on the day of departure. In the event that the Customer does not use one or more meals, no refund will be made. The Customer is reminded that drinks are not included with meals unless otherwise indicated on the Site. If the water is not included, the Customer will bear the costs necessary for his purchase.

35. Car rental

The car rental services are services offered by professional Partners / Suppliers and to which MeTour LTD is not directly responsible and which can be purchased by Users / customers in a direct contractual relationship with the supplier with whom you made the booking. and be offered either as part of an Expedia Travel Package or separately from the Third Party Provider in question. Car rental services are subject to the Rules and Restrictions of the relevant Third Party Supplier and to the precisions of these General Sales Conditions.
30.1 - Method of payment
The client making the booking and the indicated driver must present a valid credit card and the she / he registered at the time of collecting the car. Debit cards (debit cards) will not be accepted and it will be the Customer's responsibility to verify which credit cards are accepted by the Third Party Provider.
During the rental period, the Third Party Supplier may request the customer's credit card issuing bank to pre-authorize a certain amount to be intended as a deposit that will be kept by the Third Party Supplier. The Client and the indicated driver must therefore contact their credit card issuing bank to ensure that the credit limit of their card is adequate for this purpose. Some larger types of vehicles require two credit cards.
If the Customer does not comply with the conditions described above, the Third Party Partner / Supplier may not make the car available and the full cost of the car rental will be charged.
30.2 - Supplements
Additional costs such as refueling, additional driver costs and young driver supplements and delivery and collection fees can be paid locally. MeTour LTD cannot be held responsible in any way for the payment of such additional costs as detailed or otherwise.
An additional amount may be applied in the event of theft or damage to the rented car. It will vary depending on the Third Party Supplier and the rental country. It will be possible to reduce / eliminate this amount by acquiring an optional additional cover (called super CDW or super TP) on the spot. MeTour LTD and / or Third Party Suppliers cannot be held responsible in any way for the charging of this amount or the provision of additional coverage as detailed or otherwise.
Fuel is not normally included in the car rental rate. For car hire in some countries, some Third-Party Suppliers automatically charge the cost of refueling when the car is returned. In addition, some Third Party Suppliers charge a surcharge for the use of snow tires. See the Rules and Restrictions applicable at the time of booking.
Unless otherwise agreed, the Customer will have to return the car to the provider of the Third Party from which it was collected. If the Customer fails to comply with this condition, the Third Party Supplier may charge an additional surcharge.
Special equipment such as child seats can be requested and must be paid directly to the Third Party Supplier at the time of collection (where available).
30.3 - Collection / use of the car
Drivers will generally need to be aged between 21 and 75, although this requirement may vary depending on the Third Party Provider and the country. It is the Customer's responsibility to request information directly from the Third Party Supplier. Additional costs may also be applied for drivers under the age of 25 or over 70 years.
Upon delivery of the car, all drivers must present a valid license in their name for the category of vehicle hired. International rentals may have different requirements related to driving licenses. An international driving license will be required where the driver's license is not in the Roman alphabet. Additional documentation may also be required, such as a passport or up to two proofs of the name and address. Customers will have to check the applicable Rules and Restrictions that the car rental offers for every detail on all applicable conditions to book a car rental.
Some Third Party Suppliers do not allow the rented car to be used outside the country in which it was rented.
30.4. Cancellation of unused reservations / rental days
Refunds will not be offered for reservations canceled within 6 hours of collection time or for unused rental days.

37. Merchandising Purchase Section

Although it is not the main activity proposed by MeTour ld within its own platform www.metour.it, in the "Merchandising" section it is proposed to purchase to its users / customers clothing and souvenirs under its own brand and not. The sale is concluded through the guided and safe procedure of the "cart" and perfected through the payment by bank transfer or electronic payment with credit cards or PayPal. Important information about your rights regarding the purchase of a tour package
MeTour LTD through its "www.metour.it" platform does NOT offer tourist packages, except in rare cases and in any case indicating it clearly and unambiguously in the description of the Tourist Package offer. in this case, MeTour LTD, will be considered the organizer of the Tourist Package and will apply what indicated in the following important information.
The combination of tourist services offered to you consists of a package pursuant to Directive (EU) 2015/2302. As a result, you can benefit from all the EU rights that apply to the packages. MeTour LTD will be fully responsible for the correct execution of the package in its entirety. Furthermore, as required by law, MeTour LTD has a protection plan that guarantees the repayment of your payments and, if the transport is included in the package, your repatriation in the event of insolvency.
Fundamental rights pursuant to directive (EU) 2015/2301

If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction if the relevant costs decrease.
- Travelers can cancel the contract without having to pay the withdrawal fees and get a full refund if any of the essential elements of the package, other than the price, have substantially changed. If, before the start of the package, the professional responsible for the package cancels the package, the travelers will be entitled to obtain a refund and, if necessary, compensation.
- Travelers may, in exceptional circumstances, withdraw from the contract before the start of the package without incurring withdrawal fees. For example, if there are serious security problems at the destination that may affect the package.
- In addition, travelers can at any time, before the start of the package, withdraw from the contract upon payment of adequate and justified withdrawal costs.
- If, after the start of the journey, substantial elements of the package cannot be supplied as agreed, suitable alternative solutions will be offered, at no additional cost. Travelers can terminate the contract without incurring expenses, if the services are not performed in accordance with the contract and this significantly affects the execution of the package and if the organizer has not remedied the problem.
- Travelers are also entitled to a price reduction and / or compensation for damages in the event of failure or non-compliance with tourist services.
- The organizer is obliged to provide assistance if a traveler is in difficulty during the trip.
- If the organizer or, in some Member States, the supplier becomes insolvent after the start of the package and if the package includes transport, the repatriation of the travelers is guaranteed.

43. Attachment 2- Standard information form on connected tourist services

Important information about your rights regarding the purchase of a connected tourist service
Sometimes you may find yourself booking a connected tourist service as a result of the different Services you choose to purchase. In this case, the following information will apply.
If after selecting and booking a tourist service, you book additional travel services for your trip or your holiday through MeTour LTD, you will not benefit from the rights that apply to the packages pursuant to Directive (EU) 2015/2302. Therefore, MeTour LTD will not be responsible for the correct execution of individual tourist services. In case of problems, please contact the service provider concerned.
However, if during the same visit to the site "www.metour.it" of MeTour LTD you book additional tourist services for the same trip, these services will become part of a connected tourist service. In this case, MeTour LTD, as required by the law of 'EU, has a protection plan to reimburse your payments for services not provided due to the insolvency of MeTour LTD.This protection does not provide for repayment in the event of insolvency of the relevant service provider.
Note: this insolvency protection does not cover contracts with third parties, other than MeTour LTD, which can be executed despite the insolvency of MeTour LTD.
